TERMS AND CONDITIONS

Patrons understand that by entering Messiah Studios and booking any service they are agreeing to all Terms and Considerations. The authorised recipient of the Booking Confirmation acknowledges the acceptance of the below Messiah Studios Terms and Conditions of trading by Client:

Confirmation of studio booking by client
A booking is considered confirmed after the client has either called, emailed, messaged or booked online. It is then the responsibility of the client to confirm or contact Messiah Studios for any changes.
Once confirmed either full payment or a 50% deposit will be required to secure the booking, and you will be notified of the charges and issued with an invoice for your deposit.
Single day and longer sessions require payment of 50% to secure the booking, the final 50% is then required on completion of the project.
We will retain all files and content from the session until the balance has been settled. The 50% deposit is completely refundable until 48hr before the booking, after that cancellation or postponement fees will be charged.
We accept credit card, bank transfer, EFTPOS, cash and afterpay.

Cancellation, postponement, late and no shows for confirmed studio bookings
Once a booking is confirmed, a 50% cancellation or postponement fee applies up to 48 hours prior to cancellation/postponement, or 100% if a no show or cancelled/postponed within 24 hours of the booking. Lateness on confirmed bookings may result in additional fees of $110 inc get per hour late.

Charges
The artist/s, producer/s, and engineer/s attending studio sessions on Client’s behalf are deemed by Messiah Studios to be duly authorised representatives of the Client. It is the Client’s responsibility to set limits on charges arising from or for sessions. Messiah Studios are not liable for any costs or expenses incurred by the Client’s representatives during the course of or related to studio sessions.

Quotes/Prices
All quotes and prices provided by Messiah Studios for prices and flat inclusive rates will be valid for no longer than 3 months, after which a new quote will need to be issued. Prices are quoted per job and based off specifications, time length and turn around. Messiah Studios has the right to cancel or change any quote at any time without notice and in its sole discretion. Deposits cannot be applied to previous purchases nor combined with any other offers or discounts unless explicitly noted. Deposits/ quotes and Prices are specific to a service and can not be applied to other services, engineers or products.

Time Frames/Turnaround
Project management, time frames and bookings are the sole responsibility of the client. It is the Client’s responsibility to set time frames and communicate desired turnarounds on sessions. Messiah Studios have a minimum one week turn around from the point of masters to first revision.

Cleaning & damages
Messiah Studios retains the right to charge the Client a cleaning and damage fees in the event that there is any damage to the studio, equipment, infrastructure, or facility, which includes but is not limited to spills, water damage, mistreatment of equipment and accidental damage. This charge also pertains to smoking of any kind, as this prohibited throughout the entirety of the facility.

Goods and service tax
All prices quoted are exclusive of Goods and Services Tax unless otherwise stated. Prices are subject to addition of Goods and Services Tax and any other tax or charge imposed by any Government agency on goods or services quoted or on production, sale, distribution, delivery or on any feature of such goods and services if applicable. All such taxes are payable by the Client and will be added to the price by Messiah Studios.

Payment Terms
Unless prior credit arrangements have been approved in writing by Messiah Studios, payment in full is required before the completion of any projects. All materials, tapes, discs, and computer files/drives created at Messiah Studios remain the property of Messiah Studios until payment is received in full. Remittance is accepted by all major credit cards, cash and direct deposit. The Client will be liable for any fees, costs and expenses incurred by Messiah Studios for any debt collection process. Where credit terms have been agreed, payment is strictly 7 days from the date of invoice. If Messiah Studios invoice is not paid within 7 days of receipt of invoice, Messiah Studios may charge the Client interest on any unpaid amount at the prevailing Reserve Bank of Australia cash rate plus 3% and recover any costs incurred in recovering unpaid amounts (including legal costs) on an indemnity basis.

Refund Policy
Unless there is a technical fault with the recordings or masters provided, Messiah Studios does not offer refunds.

Masters Delivery
Once mastering is complete and payment has been received in full, masters will be delivered as digital files to the provided client email address, unless requested otherwise. If delivered by post or courier, the client is responsible for these charges.

Mix Delivery
Once paid in full, mixes are delivered within 14 working days from the final day of tracking.

Referral Program
The referral program is open to all individuals world wide. The program works when the individual sets up their own individual code with Messiah Studios. Codes are only valid for online bookings and only for amounts greater than $400 Australian dollars. Payment to the individuals account will be paid within 7 days of funds being received from their referral booking. The amount of $100 is in that of the AUS dollar and all fees and transactions for transferal into other currencies will be at the expense of the individual.

Occupational health & safety
Clients and their representatives located on Messiah Studios premises must comply with Messiah Studios occupational health and safety guidelines. Messiah Studios reserves its rights absolutely to refuse use of any Client or Client representative’s equipment (including software) on Messiah Studios premises if, in Messiah Studios opinion, such equipment exposes Messiah Studios property to risk of loss or damage, is unsafe or breaches occupational health and safety laws including failure to comply with Electrical Safety Standards AS/NZS 3760:2003.

Working on site / restrictions on attending studio sessions.
If you have a suspected or confirmed case of COVID-19, you are not permitted to attend site and need to isolate yourself immediately to prevent it spreading to other people. This extends to Messiah Studios staff / team members and all Messiah Studios clients.
Similarly you are not permitted to attend the studios and must self isolate if you exhibit the following:

If a family member or household member is diagnosed with COVID-19

If you are showing any flu like symptoms

If you have returned from overseas travel within 14 days

If you have attended a gathering of over 500 people within 14 days
Messiah Studios reserves its rights to refuse any staff member or client who does not comply with the above.

Damage and loss
The Client indemnifies Messiah Studios and its employees against all and any losses, damages or claims by third parties howsoever arising in respect of any loss or damage to any property including tapes, disks and media, corruption of data or computer systems and software, breach of intellectual property rights, personal injury or death, breach of contract or breach of law caused by an act or omission of the Client or its representatives. The Client is liable for all and any losses, damages or claims in respect of any loss or damage to any of Messiah Studios property including tapes, disks and media, corruption of data or computer systems and software, breach of Messiah Studios intellectual property rights, personal injury, breach of contract or breach of law caused by an act or omission of the Client or its representatives. To the extent permitted by law, Messiah Studios is not liable for any losses, damages or claims arising out of or in connection with this contract, the use of Messiah Studios premises or equipment (including software) by the Client or its representatives, the provision of services or advice by Messiah Studios or its employees, including but not limited to breakdowns or defects in equipment, facilities, and materials provided by Messiah Studios or any default on the part of Messiah Studios or its employees in connection with or during the carrying out of any work by Messiah Studios or its employees. Whilst every effort is made to ensure reasonable security, Messiah Studios accepts no liability for loss, theft or damage to Client property, tapes or recording/backup media whilst on our premises. In the case of transfers from old medium (eg; analog tapes, old tape or old digital formats) to new, Messiah Studios makes no guarantee of success. All care but no responsibility will be taken during the process of transfer. Messiah Studios equipment and specifications are subject to change without notice.

Archiving
If archiving of mastered projects is requested, Messiah Studios archives the material on the most reliable media available at the time of archiving. Messiah Studios takes utmost care with the archiving and storing of materials, but will not take responsibility for media that deteriorates over time, breaks, develops faults, or is in a format that becomes obsolete. Messiah Studios does not guarantee the archives can be recovered and the service is used for convenience and not to maintain data integrity.
